Throttle Up Propellers Warranty

 

LIMITED ONE YEAR PROPELLER WARRANTY
Throttle Up Propellers warrants the propeller to the original purchaser of the propeller on all new CNC Propellers.    Effective January 1, 2007, warranty on all Throttle Up Propellers, CNC Propellers purchased or replaced under warranty, will be one year from the date of purchase against defects in manufacturing materials. We will replace or repair our propellers without charge for parts or labor. This warranty is a warranty against blade failure and blade failure due to casting defects or workmanship This warranty must be registered with Throttle Up Propellers and is non transferable to subsequent owners. The warranty applies only to propellers that, do not reveal obvious damage from service misuse, hitting submerged objects, tampering, including sand or bottom contact, this decision is based upon our methods of inspection.  Upon returning your propeller please send the propeller with the original sales receipt and original container to Throttle Up Propellers. Warranties are available up to 800HP, which will be documented upon placement of original order and those in excess of 800HP cannot and will not be warranted, with out the expressed written consent of Throttle Up Propellers. Also, any propellers used for racing, poker runs, or in our judgment, performance equivalents to racing will not be automatically warranted but are again under the discretion of Throttle Up Propellers warranted policies. Propellers modified, thinned, sharpened, up pitched or down pitched, reworked, or with nicked leading edges are not covered under warranty. The warranty applies only to the original owner with the original sales receipt. The owner of the propellers is responsible for all shipping fees incurred in the repair / exchange process.

PURCHASER OBLIGATION
Original purchaser must complete registration card within 30 Days of purchase, at the time of receipt, and it must be forward to Throttle Up Propellers within 10 days of receipt. When requesting warranty repair or exchange, the original purchaser must contact Throttle Up Propellers for a return authorization number and must include a copy, of the original invoice with the defective propeller.

WARRANTY REPAIR, EXCHANGE, OR REPLACEMENT
Throttle Up Propellers, warrants that any defective propeller will be repaired or exchanged without charge other than shipping charges. If, upon examination of the returned propeller, the warranty is approved, the repaired or replacement propeller will be returned to the purchaser. Throttle Up Propellers reserves the right to replace the defective propeller with an identical or similar propeller in current production, at the time the propeller is returned.

WHAT IS NOT WARRANTED

*Propellers that have been remanufactured, rebuilt, repaired, or modified.

**Any damage caused to boat, motor, running gear and/or power trains

Failure of hub insert. Those applications of the propeller where transom motor heights are such that non-production water pick-ups are required are used for adequate water pressure.

           Or Damage caused by:

1.     Misuse, negligence, modifications, accident, abnormal operations or product application

2.     Participation in, or preparing for racing, or other competitive activities

3.     Grounding or striking foreign objects

4.     Cavitation, **corrosion, or electro chemical action.

• Transition: The loss of use of boat, loss of time, inconvenience, or other incidental charges such as boat haul out, crane service, forklift rental, telephone calls, tow and storage, car and boat rental, food, etc., or other consequential damages, except where required by law. ** All stainless steel propellers contain a small amount of nickel alloy. Under certain conditions, surface rust or corrosion may appear due to the iron / nickel content.
  
  GENERAL TERMS
  The warranty set for the propellers by Throttle Up Propellers, is exclusive and in lieu of all other warranties, whether oral or written, expressed or implied. No warranty of merchantability or fitness for a particular purpose shall apply except during the duration of this written warranty Throttle Up Propellers, does not authorize any individual or corporation to create for it any obligation, liability, or other warranty in connection with this product. This warranty is intended to comply with Federal statutes and regulation, and the law of the State of Florida. In no event shall Throttle Up Propellers, be liable for incidental or consequential damages. Some states do not apply. VENUE:  Should any litigation result from the sale or use of a Throttle Up Propellers product, the venue for litigation shall be in Pinellas County, Florida and this litigation shall be construed under the laws of the state of Florida.
  ATTORNEY’S FEES:  Should any attorney litigation result from the sale or use of Throttle Up Propellers products, the prevailing party shall be entitled to reasonable attorney’s fees including court costs.
